P's husband was known to be 'melancholy, very irritable, and unable to sleep. Knowledge of what had happened would have driven him insane. Under this 'duress' P signed a settlement agreement because she was afraid of what the incident would do to her husband. The verdict was directed for D in the lower court, and P appealed.
