P, as executrix of the estate of Rufus Salter, alleged that D failed adequately to test and label its prescription drug Cleocin. Rufus received the drug and died. P requested three times that the trial judge allow her to take the deposition of D's president, Dr. Hubbard. The judge denied her request. D sought an order protecting Dr. Hubbard from the first deposition. The trial judge granted defendant's motion. P also made two other motions to take the deposition but asked that it be conducted in Montgomery Alabama when D’s office was in Michigan. Both were denied. P lost the case and appealed.
