Lawrence v. Walzer & Gabrielson

207 Cal.App.3d (1989)

Facts

Walzer (D) was sued by Lawrence (P) for legal malpractice. The retainer agreement that P signed called for arbitration. P hired D to represent her in a dissolution of her marriage. P then sued D for malpractice and D moved for arbitration. P claimed that she had no idea that the retainer agreement she signed meant that she could not have a jury trial for attorney malpractice. P claimed she would never have signed the agreement had she known its contents. The lower court denied the petition to compel arbitration. D appealed.
