In Re Groffma L W.L.R.

733, 2 All E.R. 108 (1968)

Facts

Groffman signed his will and then went to the home of some friends and asked them to act as witnesses. Both people signed as witnesses. The first signed his name in the presence of the Groffman but not in the presence of the second witness and the second witness signed in the presence of Groffman but in the presence of the first witness. Groffman did not sign the will in the presence of either witness. Mrs. Groffman (P) challenged the validity of the will because it was improperly executed. The will was denied probate because it did not meet statutory requirements.
