Facts

D is a corporation engaged in retailing. D maintains an optical department. Ds without P's knowledge or consent signed his name to the following telegram to the governor urging the veto of a bill. The bill would have prevented D from continuing to engage in the business of fitting and selling optical glasses to the public. P is also a Classified Civil Service Employee of the United States Government. He is prohibited from engaging in political activities. P claims that Ds' jeopardized P's position and his right to receive a pension upon reaching the age of retirement. P sued Ds alleging mental anguish. P sought $20,000, of which the sum of $10,000 is punitive damages. D demurred, and the trial court sustained, and P appealed.
