Groves (P) petitioned the court for specific performance of an agreement for visitation that had been entered into between P and the Clarks (D). P was the natural mother of Laci. P had become acquainted with D who had lulled P with a promise of an open adoption so that P would have visitation rights with the child after the adoption was finished. P was adamant that she would not consent to adoption unless a visitation agreement was signed first. The agreement was signed. The adoption occurred but at no time during the adoption process was the agreement mentioned. D then cut off the visitations. P asked for specific performance. The trial court held the agreement void as a matter of law.
