Facts

A trust was created for the testator's daughter for her life and then provided for the continuation of the trust for the purpose of making payments of $300 per month to the testator's son. The conditions of those payments were for as long as the son was married to his present wife. The trust was to terminate at such time that the son divorced his present wife or as such time his present wife died. The residue was then to be distributed $5,000 to a niece, and the balance of the trust to the son. The estate was substantial and the amount potentially to be distributed was $100,000.
