E.I. Du Pont De Memours & Co. v. Claiborne Reno Co.

64 F.2d 224 (8th Cir.), cert. denied, 290 U.S. 646 (1933)

Facts

Du Pont (P) sued Reno Co. (D) for almost $6,000 for goods sold and delivered. D countersued for $350,000. D was the sole distributor of P's products in Iowa. Those products were used for the finishing, refinishing, and polishing of cars. D was the sole distributor from 1924 until 1930 when P gave notice to terminate the relationship. D claimed that under the terms of the contracts agreed to P could not terminate so long as the services of D were satisfactory in the judgment of D. D claims that P was not dissatisfied with its services and that the termination was in bad faith. The jury awarded D $41, 588.12. P appealed.
