Facts

Quirk (D) challenged his opponents in an effort to fluoridate water. D was against fluoridation, and the Cudahy Junior Chamber of Commerce (P) was for it. D offered to give P $1,000 if a daily dose of four glasses cannot cause dermatologic, gastrointestinal and neurological disorders and if P found that D misrepresented matters D will then pay the sum of $1,000. After some quick checking, P demanded the payment. D refused and P sued in court. The jury found misrepresentation and judgment was granted to P. D appealed.
