Commonwealth v. Kelle

35 D. & C. 2d 615 (1964)

Facts

Keller (D) had two children. She claimed that the first one was born dead. Instead of burying the body, D wrapped it up in a blanket and kept it in her basement for several months. The second child was born alive, but D strangled it to death and hid the body. D was convicted of indecent disposition of a dead body. She moved that the indictment should be quashed because it was not a recognized crime. The motion was denied by the trial court. D appealed.
