Facts

Carter (P) et al. commenced an action against officials charged with the administration of the State's jury selection laws (D). P claimed that Negroes were systematically excluded from jury selection, and gave overwhelming evidence to support their claim. The District Court found that there was an invalid exclusion of Negroes on a racially discriminatory basis, but declined to overturn the Alabama statute.
