Facts

The tenant who erected buildings for the purpose of operating a gas station wanted to remove the buildings at the expiration of the leasehold. The lease contained no specific provision for ownership of the buildings at the expiration. The landlord did not claim that the buildings were on the property when the lease was made nor that he had contributed anything to their building. The landlord claimed that the structures were more or less permanent, remain part of the real estate and may not be removed. Tenant contends that they were erected for the purpose of carrying on its business and may be removed by him.
