Facts

Drudge (D) created a web page called the Drudge Report. It was published in his apartment office in Los Angeles, Ca. D entered a licensing agreement with Wired magazine for Wired to display D’s reports in Wired’s new electronic publication. When the deal with Wired expired, D entered into a new agreement with AOL and subscribers to AOL got access to D’s report. D was paid $3,000 per month. D created a new report about Blumenthal (P) accusing P of spousal abuse. D emailed the report to AOL. The next day, D retracted the story and apologized. P sued Ds, and AOL (D) moved for summary judgment.
