Facts

Bastan (P) contracted with RJM (D) to build a house. In his fourth count of the complaint, P seeks to hold Robert Moravek, Sr. (D1) personally liable as well. D1 is the sole and only member of D. P alleged that D1 is the controlling member of D and used it for his own personal gain draining it of assets so that D would not meet its obligations. D1 contends that there can be no piercing of the LLC veil. D1 contends that the statutory scheme allows for an individual to manage an LLC.
