Facts

Ds were at the Supreme Court protesting the mistreatment of prisoners at the Abu Ghraib and Guantanamo Bay and the appointment of Alberto Gonzales as Attorney General. Potts was wearing a black hood; Barrows was wearing an orange jumpsuit and black hood, and Perry was holding a sign over his head that read 'no taxes for war or torture.' Ds ascended several steps from the sidewalk to the plaza in front of the Supreme Court building. Police repeatedly asked Ds to return to the sidewalk and arrested them when they refused to do so.
