Facts

P is a resident at one of the apartments owned by defendant Chicago Housing Authority (CHA). Westinghouse (D) maintains and services the elevators at the building. P entered the elevator on the first floor and rode it to the 16th floor. As she attempted to exit, the elevator stalled and the doors remained closed. P was imprisoned for 40 minutes. P claims that during that time she was in danger of 'suffocation and serious physical harm.' P claims she suffered an unstable angina and aggravation of her coronary arteriosclerotic heart disease and hypertension. P sued Ds for negligent infliction of emotional distress. Ds moved to dismiss and it was granted. P appealed.
