Facts

Apparently New Jersey passed an act forbidding the taking of oysters by any persons, state citizens, and nonstate citizens alike. The ordinance forbids harvesting the oysters at unseasonable times, and with destructive implements. Penalties and forfeitures were proscribed. Counsel for the plaintiff stated that the laws were a regulation of the external commerce of the state.
