Brown v. Allen

344 U.S. 443 (1953)

Facts

Four cases were consolidated: Clyde Brown and Raleigh Speller (Ps) were convicted of interracial rape; Bennie Daniels and Lloyd Ray Daniels (P) were 17 years old when convicted of murder. The State Supreme Court denied Ps’ appeals and the Supreme Court denied certiorari. Ps filed federal habeas corpus claiming racism in the jury selection and a coerced confession. The federal court reviewed the state records and took additional evidence in some. The court denied the petitions. The Court of appeals affirmed. Ps appealed.
